McClellanville Town Council
Monday, March 6, 2006 – 7:00 PM

The Mayor and Council met on the above noted date. Mayor Rutledge Leland presided and all Councilmen were present; Aaron Baldwin, Bob Gannon, Gussie Humes, and Jim Scott. Town Administrator Mary Duke and administrative assistant Dorothy Small were present to record the minutes. Guests present included Marina Baldwin, Bud Hill, Sam Watson, Bill Youngman, and two local high school students.

The minutes from February 6, 2006 were read. Gussie made a motion to approve the minutes as written and Jim seconded the motion. Council voted unanimously to approve the minutes.

Bill Youngman addressed Council with his and his brother-in-law, Johnny Moses’ concerns about lots on Legare Street. He explained that during a survey, it had been found that during the last few years, the traveled area of the road had shifted out of its right-of-way onto Mr. Moses’ lot. Mr. Youngman said that he had met with Chuck Jarman, an engineer with Charleston County Public Works, who indicated that the county will realign the road if the Town requests it to do so. Rutledge suggested having Jimmy McClellan survey the road and stake out where the road is supposed to travel and notify adjacent property owners who may not realize the road has left the right-of-way.

Council next noted that there were no representatives from Archibald Rutledge Academy. Dorothy noted that she thought that the Academy was going to request closing the end of Pinckney Street, Lofton Court, and Thomas Pinckney Court the day of the Shrimp Festival. Council asked what the reasoning was behind the request and Dorothy noted that she understood that the festival coordinators were looking into having a Ferris wheel at the end of Pinckney Street. Dorothy also noted that when she asked Frances Cantwell who should approve the street closing, Frances had reservations about closing the road and had said that the Academy should get approval from local emergency responders as well as from the nine households affected by the closing. Bob noted that he thought that DOT should be notified or issue a permit to close Pinckney Street since it is a state maintained road.

Council then considered two alternatives of an ordinance to transfer election authority to Charleston County. Mary noted that Frances had asked Council to hold off on a final reading until she and Marilyn Bowers had worked out some of the lingering questions about protests and costs associated with protests.

Council then reviewed Nic Church’s letter seeking to be appointed to the Board of Zoning Appeals. Several Council members had questions about his ability to attend meetings as well as complete the orientation training requirements. Gussie made a motion to appoint Mr. Church to the BZA and Aaron seconded the motion. Council voted unanimously to appoint Mr. Church to the Board of Zoning Appeals.

Bob made a motion to re-appoint Gabe Purvis and Eddie Richards to serve another term on the Board of Zoning Appeals and Gussie seconded the motion. Council voted unanimously to re-appoint both members.

Bob made a motion to re-appoint Elizabeth Dawson, Suzanne Britt, and Sonny Phillips to the Board of Review. Jim seconded the motion and Council voted unanimously to re-appoint the three members.

Council then reviewed the proposal for a fireworks display for the Fourth of July from Mr. Kenny Keith. They noted that the $1,000.00 cost was for the fireworks only and there was no charge for the labor. Rutledge noted that the proposal said Mr. Keith would need an open place and access to water. Council directed Mary or Dorothy to meet with Mr. Keith and find out what area would work best and to see if it was going to be feasible.

Sam Watson with the McClellanville Civic Club told Council that the Civic Club was coming up with a program to clean up the streets in Town and the surrounding community as a joint effort with four local schools, the Town, and area businesses. Jim asked what sort of financial contribution the Civic Club was expecting from the Town. Bud noted that they were hoping to be able to award $1,000.00 as a first place, $500.00 as second place, $300.00 as a third place and $200.00 as fourth place. Rutledge and Mary said that the budget was tight but would see if there was extra money available. Mary noted that the donations budget was somewhat over-budget at the moment but that she would check to see if some money could come from another line. Rutledge noted that he hoped that the Civic Club would be able to collect most of the money from the local businesses. Mr. Watson noted that the Civic Club would also like to use the bandstand area as the trash collection site and said that they would work with the County to have it hauled away.

Council considered holding a ribbon cutting ceremony for the boat landing, once the construction was finished. Rutledge noted that the ceremony might be held on short notice since boaters were anxious to begin using it as soon as it was ready.

Council noted the request from the Municipal Association to observe March 13-18 as Sunshine Week. By unanimous consent, Council agreed to observe Sunshine Week and asked Dorothy and Mary to advertise it in the Newsletter.

Mary noted that several of the counties and municipalities involved with the pact to limit growth in the Francis Marion National Forest would be holding another meeting the following morning and asked if Council wanted her to attend, or if they wanted to choose another representative. Aaron noted that he had attended the first meeting and would be able to attend the upcoming meeting as well. Gussie noted that he would also try to attend the meeting. Aaron asked if the Town should have an official position. Council instructed him to go to the meeting to gather more information, that the town had no official position.

Rutledge noted that there was a meeting held by SCE&G on March 23 regarding emergency preparedness for any municipal officials. Gussie said he would be able to attend the meeting as a representative from Council.

Council, by unanimous consent, declared March Red Cross Month in McClellanville and had Rutledge sign an official proclamation that would be returned to the Red Cross.

There being no further business, a motion was made, seconded and unanimously carried to adjourn the meeting at 8:05 PM.
